The driver, 12 hours into his shift, drifted into the path of an oncoming truck. WorkSafe’s investigation found the company had failed to provide essential information, instruction, and training on fatigue management, and did not ensure workers received necessary rest breaks or supervision1. 

Why Fatigue Management Is a Legal and Moral Imperative 

This case is not an isolated incident. In 2024 alone, Victorian employers faced over $13 million in fines for workplace safety breaches, with transport, warehousing, and logistics among the highest-risk sectors2. Courts are increasingly holding both companies and individual directors personally accountable for failing to protect workers from known risks – including fatigue.

A 2023 prosecution by the Office of the National Rail Safety Regulator (ONRSR) highlighted this clearly – a Protection Officer was fined $50,000 for repeatedly breaching fatigue rules – knowingly working back-to-back shifts and exceeding maximum hours, despite prior warnings.

The court found his actions endangered not only his own life but also the lives of other track workers who relied on him for their safety. The case underscores that individual accountability matters⁴.
