New Drug and Alcohol Laws for Recreational Boating in WA 

Western Australia has introduced tougher drug and alcohol laws for recreational boating, aligning them with road rules to improve safety on the water.

What’s Changed? 

  • Skippers are now subject to the same drug and alcohol limits as road users—a breath alcohol (BrAC) limit of 0.05 applies.
  • On-water testing is now permitted by WA Police and Department of Transport (DoT) officers.
  • Penalties for boating under the influence include:
    • Fines up to $3,750 for a first offence.
    • Up to $7,500 and 18 months imprisonment for repeat offences.
    • Disqualification of your Recreational Skipper’s Ticket (RST).
    • Causing death while under the influence can lead to 20 years imprisonment and an unlimited fine.

These changes are part of a broader reform to the Western Australian Marine Act 1982, aimed at reducing fatalities and improving safety on WA waterways.
