The Cost of Fatigue – Lessons from the Bakeology Case

In August 2022, a contracted delivery driver for Onkar Group Pty Ltd – trading as Bakeology – shook the Victorian transport industry and underscored the critical importance of fatigue management.

The driver, tasked with an arduous overnight delivery route known as the “Albury Run”, lost his life in a collision after completing a 12-hour shift spanning nearly 800 kilometres.

It highlights the consequences of neglecting fatigue protocols and the urgent need for robust fatigue management systems.

What Went Wrong

Bakeology engaged approximately 30 subcontracted drivers to deliver baked goods across Melbourne and regional Victoria. The deceased driver had been assigned the “Albury Run” nightly, with shifts beginning around midnight and ending well into the following afternoon. Despite the gruelling schedule, there was no system in place to ensure compliance with mandated rest breaks or maximum work hours.

WorkSafe Victoria found that the driver had worked continuously from 1st  July to 17th  August 2022 without adequate rest. The company failed to:

    • Limit work hours to 10 hours in any 11-hour period with 60 minutes of rest.
    • Cap work to 12 hours in any 24-hour period with 7 hours of stationary rest.
    • Enforce weekly and fortnightly rest periods.
    • Provide training on fatigue signs, risks, and mitigation strategies.

    The result? A fatal crash caused by fatigue-induced lapse in attention.

    Legal Consequences

    Bakeology pleaded guilty to three charges:

      1. Recklessly engaging in conduct that endangered the driver’s safety.
      2. Failing to reduce the risk of serious injury or death due to fatigue.
      3. Failing to protect other road users from fatigue-related risks.


    The Court Imposed

      • A $1.1 million fine for Charge 1.
      • A $250,000 aggregate fine for Charges 2 and 3.
      • An Adverse Publicity Order requiring publication in Owner Driver Magazine.

      While Bakeology had no prior convictions and implemented an electronic rest tracking system after the incident, the court emphasised the need for general deterrence and industry-wide education.
