
Workplace safety in Australia is underpinned by clear legal responsibilities. Under the Model Work Health and Safety Act, everyone in the workplace from employers to workers has a duty to ensure health and safety, including managing the risks associated with drugs and/ or alcohol use.
For many organisations, this responsibility is formalised through a Drug and Alcohol Management Plan commonly known as a DAMP.
What is a DAMP?
A DAMP is a structured framework designed to manage the risks of drugs and/or alcohol use in the workplace. It outlines how an organisation prevents, supports and meets its legal obligations and is typically broken down into three core components.
- Education Program
- Testing Program
- Workplace Response Program
The DAMP clearly establishes areas including:
- Defining the organisation’s drug and alcohol policy and procedure
- Sets out the method, the type of testing drug and alcohol testing procedures
- Establishes roles, responsibilities, and response protocols
- Sets out the post-test protocols and procedures
- Documents how compliance with relevant laws is maintained
Ultimately, it ensures workers remain, safe, productive and fit for work, reducing risk to people, operations, and the broader community.

Industries where DAMPs are Required
While all workplaces must manage risk, some industries are legally required to implement formal DAMPs due to their higher safety risks, including:
- Aviation – regulated by the Civil Aviation Safety Authority (CASA, Part99), DAMPs are mandatory for organisations employing staff performing safety-sensitive aviation activities (SSAAs).
- Rail – required under theRail Safety National Law and overseen by the Office of the National Rail Safety Regulator (ONRSR).
- Maritime – commercial operations must manage drug and alcohol risks under the Australian maritime safety authority (AMSA).
- Heavy Transport & Logistics – governed by the Heavy Vehicle National Law requiring drivers to be physically and mentally fit to drive and NOT affected by drugs and/or alcohol.
- Mining & Construction – while notcovered by a singlenational DAMP framework, these high-risk industries require stringent testing to comply with Work Health and Safety laws.
Mining-specific Regulations
Due to the risk profile of mining in particular, state-based legislation sets strict requirements:
- WA – Work Health and Safety Act 2020 (WA) and WHS (Mines) Regulations 2022, enforced by DMIRS
- QLD – Coal mining regulated by the Coal Mining Safety and Health Act 1999 and Regulation 2017
- NSW – WHS (Mines and Petroleum Sites) Act 2013 and Regulation 2022
- SA – Work Health and Safety Act 2012 (SA), enforced by SafeWork SA
- NT – WHS (National Uniform Legislation) Act 2011, enforced by NT WorkSafe
Do all Organisations need a DAMP?
Not every workplace requires a formal DAMP. However, all organisations must manage drug and alcohol risks under WHS laws.
